The prosecution has been laying out their case to the jury stating they will prove that Donald Trump knew in October, 2016 after the Access Hollywood tape came out that Trump's affair with Stormy Daniels would be devastating to Trump's campaign and got his fixer Michael Cohen to pay off Daniels. In addition Mathew Colangelo said that David Pecker of the National Enquirer coordinated with Trump to "catch and kill" stories that would be detrimental to Trump's campaign.

The defense made their opening statement. During that the prosecution objected three times. The first was overruled, but the two others were sustained. Most prosecutors don't like to object during the defense's opening statement, but when the defense either tells the jury what the law states, which is only the judge's obligation, or makes a statement that has been precluded from the trial, the prosecution has no other alternative.

David Pecker is now taking the stand. He made a deal with the prosecution to testify in order to avoid being charged himself.

The trial for today is over. Tomorrow Judge Merchan will take up the gag order that Trump has refused to abide by and we should see what punishments Trump will have to deal with. On his way out of court today, Trump spoke for 9 minutes calling this a "witch hunt" and playing the victim as he has done so many times before now.

The transcript to the first day of Trump's trial is out and the uh oh moment was when the prosecution told the jury that the $420,000 paid to Michael Cohen was actually written down by chief financial officer and inmate Allen Weisselberg of exactly how this came to be.

Todd Blanche, Trump's lead attorney, said that Trump never slept with Karen McDougal or Stormy Daniels and he is a totally innocent person. That is likely going to stick in their throats as the prosecution brings witness after witness and all these documents to the jury. Stay tuned.

So, the prosecutor has now said that Trump has gone after Michael Cohen calling him a "serial perjurer". That is a violation of the gag order. Trump has also commented on the jury, which is also a violation of the gag order, as recently as yesterday. Judge Merchan has now asked Todd Blanche several times to answer him if Trump takes the position that He has not violated the gag order. The judge has now said that Trump's attorney has "lost all credibility with the court."

Judge Merchan has now ruled that he will reserve sanctions on Donald Trump for now. David Pecker is scheduled to continue testifying in about 12 minutes.

David Pecker has been testifying about the relationships between himself, Trump, Michael Cohen and Hope Hicks. This is setting the stage for the later testimony of these other persons later in the trial. Pecker has said that he was in charge of making certain only positive stories were written about Trump and negative ones were written about Trump's political rivals. Pecker has also testified that Trump always looked at checks presented to him for a signature, being very hands on with his image and brand. Pecker said that before 2015 he had never done a "catch and kill" of stories that were unfavorable to Donald Trump.

Pecker testified that the first story he caught and killed for Trump was concerning one where Trump was said to have fathered an illegitimate child. Pecker said that even though he thought the story was likely fake, he bought and suppressed it because it was potentially embarrassing to Trump. He paid $30,000 for all rights. The prosecution has introduced emails and documents to show a wire transfer of that amount of money.

The prosecution has now turned to June of 2016 when Karen McDougal contacted American Media Inc., the parent company of The National Enquirer, about having an affair with Donald Trump for nearly a year. She was paid $150,000 to catch and kill that story. David Pecker testified that Donald Trump called him directly and said that Michael Cohen would call him about this at a later time.

The jury is being dismissed for the day and now Trump is making a statement outside the courtroom. He is talking about the Unconstitutionality of the gag order. Trump is calling for Judge Merchan to recuse himself. Typical. Always the victim.

After the transcript of today's trial was released the reason Judge Merchan told Todd Blanche he "was losing all credibility with the court" became very apparent. Trump had found a quote by a Fox News host, and instead of reposting it he wrote out what the Fox News host said and added that liberal jurors were getting on jury. This was placed in quotes, but it wasn't a quote. Todd Blanche tried several times to say that Trump hadn't violated the gag order. Judge Merchan asked him to cite case law. He couldn't because there is none. Judge Merchan said he had asked eight or nine times to get Blanche to elaborate, but he couldn't. Hopefully Merchan will sentence Trump to jail and suspend the sentence until the end of the trial and tell Trump that if he abides by the gag order he won't have to go to jail for thirty days. Maybe that will stop Sleepy Don.

I didn't think of this until later, but you should look at Crosby, Stills, Nash and Young's song written by a Canadian Neil Young, "Ohio". Back in the 1970s at Kent State University, four students were killed by the National Guard when Nixon sent them there to stop war protesters.

Today a grand jury in Arizona returned true bills on the eleven fake electors and seven more Trump administration officials who participated in the fake electors scheme. This includes Rudy Giuliani and the GOP chairwoman for the state. Mark Meadows was also indicted.
