No the SCOTUS didn't take up the case because Kavanaugh wanted to let the issue peculate in the lower courts 1st, SCOTUS will eventually take the case if the lower courts don't get it right, this is not an uncommon move for the SCOTUS when deciding on taking a case.
After considering them at 15 consecutive conferences, the Supreme Court on Monday declined to take up two challenges to gun-control laws in Maryland and Rhode Island. In each case, three justices indicated that they would have granted the petition for review, leaving the challengers one vote short of the four needed for the court to hear oral arguments and weigh in on the merits of their case.
So to be clear SCOTUS did not rule on the cases, they deferred on taking the cases, for now.
That said Kavanaugh signaled that he would in time vote with the others to take the cases.
p.s. I'm not against helping people in Africa, but we need to do our good deeds without government graft and corruption.
